1. Acceptance of Terms

By accessing or using the GameForge website located at https://ulcorexwebllc.com and purchasing gaming peripherals from us, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access our website or purchase products from us. These Terms apply to all visitors, users, and customers of our website.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to use our services. By placing an order, you represent and warrant that you meet these eligibility requirements. If you are purchasing gaming accessories on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

3. Definitions

  • “Site” refers to the GameForge website at https://ulcorexwebllc.com
  • “Products” refers to gaming peripherals sold on the Site, including mechanical keyboards, custom keycaps, mousepads, RGB lighting, controller grips, headset stands, and streaming microphones
  • “Order” refers to a request to purchase Products submitted through the Site
  • “User” or “you” refers to any individual who visits or uses the Site
  • “We”, “us”, “our” refers to ULCOREX WEB LLC

4. Products and Pricing

All gaming peripherals are displayed on the Site with descriptions, specifications, and images intended to be as accurate as possible. However, we do not warrant that product descriptions, images, or other content on the Site are accurate, complete, reliable, current, or error-free. RGB lighting effects, keycap colors, and product dimensions may vary slightly from on-screen representations due to monitor calibration and manufacturing tolerances.

  • All prices are displayed in US Dollars (USD) and are subject to change without notice
  • We reserve the right to limit order quantities, especially for limited-edition keycap sets and artisan products
  • Product availability is subject to change without notice
  • Prices displayed at checkout are final and supersede any previously displayed prices
  • We are not responsible for pricing or typographical errors on the Site

5. Orders and Payment

By placing an order, you make an offer to purchase the selected gaming peripherals. We reserve the right to accept or decline any order at our discretion. If we decline your order, we will refund any payment already collected. Payment must be received and verified before we ship your order.

  • All payments are processed securely through PCI-compliant payment processors
  • We do not store your full credit card information on our servers
  • By submitting payment, you authorize us to charge the designated payment method for the total order amount including shipping and applicable taxes

6. Shipping

7. Returns and Refunds

8. Warranty

Gaming peripherals sold by GameForge are covered by our warranty. Most products include a 1-year manufacturer warranty, and accessories include a 30-day warranty. For full warranty terms, see our Warranty Policy.

9. User-Generated Content

You may submit reviews, ratings, photos, and other content related to gaming peripherals on our Site. By submitting User-Generated Content (“UGC”), you grant GameForge a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, distribute, and display that content in connection with our business.

  • You represent that you own or have the rights to all UGC you submit
  • You may not submit UGC that is defamatory, obscene, infringing, or otherwise unlawful
  • We reserve the right to remove or edit any UGC at our discretion without notice
  • You are solely responsible for the UGC you submit and any consequences arising from it
  • We do not endorse and are not responsible for the accuracy of any UGC on our Site

10. Intellectual Property

All content on the Site, including the GameForge name, logo, product descriptions, images, website design, graphics, text, and software, is our property or licensed to us and is protected by United States intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

The GameForge name and logo are trademarks of ULCOREX WEB LLC. All other trademarks, service marks, and trade names appearing on the Site are the property of their respective owners.

11. Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any local, state, or federal law
  • Attempt to gain unauthorized access to any portion of the Site, other accounts, or computer systems
  • Use bots, scrapers, or automated tools to extract data from the Site without our consent
  • Interfere with or disrupt the Site, servers, or networks connected to the Site
  • Submit false or misleading information when placing an order
  • Resell products purchased from us without our prior written authorization
  • Use the Site to send unsolicited commercial communications

12. Accounts

You may create an account to track orders, save shipping addresses, and receive personalized product recommendations. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account by emailing support@ulcorexwebllc.com.

13. Limitation of Liability

To the maximum extent permitted by law, GameForge and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Site, your purchase of gaming peripherals, or any products or services obtained from us.

Our total aggregate liability arising out of or related to these Terms or your purchase of products shall not exceed the total amount you paid to us for the specific product(s) giving rise to the claim. This limitation applies to all causes of action, whether based on contract, tort, strict liability, or any other legal theory.

14. Disclaimer of Warranties

The Site and all gaming peripherals are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. RGB lighting effects, switch actuation feel, and product longevity may vary based on usage and environmental conditions.

15. Indemnification

You agree to indemnify, defend, and hold harmless GameForge and its officers, directors, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorney fees, arising out of your use of the Site, your violation of these Terms, your infringement of any third-party rights, or your User-Generated Content.

16. Force Majeure

GameForge shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay is caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, civil unrest, labor disputes, supply chain disruptions, component shortages (including semiconductor or switch shortages affecting keyboard production), government actions, or failures of internet, telecommunications, or hosting infrastructure.

17. Governing Law

These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of New York, United States of America, without regard to its conflict of law principles. You and GameForge agree to submit to the personal jurisdiction of the courts located in New York for any disputes not subject to arbitration as described below.

18. Dispute Resolution — Arbitration

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the gaming peripherals purchased from us, including but not limited to product defects, warranty claims, and billing disputes, shall be resolved by binding arbitration administered by the Judicial Arbitration and Mediation Services, Inc. (“JAMS”) under its Streamlined Arbitration Rules and Procedures then in effect, except as otherwise provided herein.

Federal Arbitration Act: This arbitration agreement shall be governed by and enforceable under the Federal Arbitration Act (9 U.S.C. §§ 1-16) and the rules of JAMS. The arbitrator shall be a retired judge or attorney with at least 10 years of experience in commercial/consumer matters.

The arbitration shall take place in New York. The arbitrator shall apply the substantive law of the State of New York, United States of America. The arbitrator's award shall be final and binding, and judgment may be entered on it in any court of competent jurisdiction.

You may initiate arbitration by sending a written demand to support@ulcorexwebllc.com or to our physical address listed below. The demand must include your name, contact information, the nature of the dispute, and the relief sought.

19. Class Action Waiver

You and GameForge agree that each may bring claims against the other only on an individual basis and not as a plaintiff or class member in any purported class, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. The award of the arbitrator shall be limited to the individual claims of the parties before the arbitrator.

20. Opt-Out of Arbitration

You may opt out of this arbitration agreement by sending a written notice to support@ulcorexwebllc.com or to our physical address listed below within 30 days of your first purchase from GameForge. The notice must include your name, address, phone number, email address, and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, disputes will be resolved in the courts ofNew York as described in Section 17.

21. Small Claims Court

Notwithstanding the arbitration provisions above, either you or GameForge may bring an action in small claims court in the county where you reside or in New York, provided the action is within the jurisdiction of the small claims court and the amount in controversy is within the small claims limit.

22. Severability

If any provision of these Terms is found to be unenforceable, invalid, or illegal by a court or arbitrator, that provision shall be severed from these Terms and the remaining provisions shall continue in full force and effect. The invalidity of any provision shall not affect the validity of any other provision.

23. Waiver

The failure of GameForge to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No waiver shall be effective unless in writing and signed by an authorized representative of GameForge. A waiver on one occasion shall not be construed as a waiver of any right on any future occasion.

24. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Returns Policy, Refund Policy, Warranty Policy, Cookie Policy, and any other policies referenced herein, constitute the entire and exclusive agreement between you and GameForge with respect to the Site and your purchase of gaming peripherals. These Terms supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.

25. Survival

All provisions which by their nature should survive the termination of these Terms shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability. If any provision does not survive, the arbitrator or court shall modify it to the minimum extent necessary to make it enforceable and the remaining Terms shall continue in full force.

26. Assignment

You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without our prior written consent. GameForge may assign, transfer, or delegate these Terms and its rights and obligations in connection with a merger, acquisition, reorganization, or sale of all or substantially all of its assets. Any attempted assignment in violation of this section shall be null and void.

27. Privacy

Your use of the Site and the collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

28. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will post the updated Terms on this page with a revised “Last updated” date. Your continued use of the Site or placement of orders after any changes constitutes acceptance of the revised Terms.
